Sale and Transfer Agreement

This Contract is made effective as of _ ___________ by and between _______________________________hereinafter referred to as “BUYER”) of  (address)_______________________________________________________________________ (Phone)___________________, and Masterpiece Shih Tzu and Stud Sanctuary of 17447 Hiawatha Beach Dr. NE, Ham Lake, MN 55304 (hereinafter referred to as “SELLER”).

1.       DESCRIPTION OF SERVICES. SELLER agrees to sell high quality full-blood Shih Tzu puppy to BUYER. SELLER will provide registration documentation of the puppy’s parents upon request by the BUYER.

2.       SALE PRICE. The purchase price of one puppy ____________is $__________ (pet price) and sold non-refundable AKC puppy. The contract will be terminated if the full payment is not received by the time the puppy is 8 weeks or agreed upon scheduled pick-up date.

3.       DEPOSIT. A deposit will be required at the signing of this contract in the amount of $300 and is non-refundable except for the cause of termination of this contract by the Seller.

4.       REASONS FOR TERMINATION. This contract may be terminated in the case of non-appropriation of funds by the BUYER to pay the remaining amount for the puppy. In the event that the contract is terminated for non-appropriation of funds, any and all deposit funds will be forfeit by the BUYER. SELLER may terminate this contract for the following reasons:

a. In the event that BUYER is delayed in paying the remaining amount for the puppy

b. In the event that the SELLER feels for any reason that the BUYER will not properly care for the puppy

c. If the puppy becomes ill and requires additional care by the SELLER

 

5. WARRANTY AGREEMENT. A one year replacement warranty is given for life threatening congenital disease. This is limited to heart, liver, and kidney congenital defects. We must receive a notarized letter from your vet with proof your puppy has been kept up to date on all veterinary care if issue arises. The vet must state the finding and stating to a medical certainty that the puppy has/had a specific condition listed that is/was the cause of demise. All vet bills are solely the responsibility of the new owner. Masterpiece Shih Tzu Sanctuary must confirm also with our veterinarian and the vet must confirm and agree with the diagnosis. All vet reports and medical records must be sent by the BUYER’s treating vet to SELLER. A replacement puppy will be given of equal value as a new litter is available. The SELLER has one year to replace the puppy. If the puppy was vaccinated, has produced offspring, or was spayed or neutered prior to 24 months, found to be malnourished, neglected or abused, the contract is terminated. This contract is not transferable.

6. COMMON UNCOVERED. There are several items that are not covered under the warranty. They are neither life threatening nor a genetic hereditary condition. These are a few but not limited to; umbilical hernias and tight nostrils which are very common in the Shih Tzu. If the new owner wishes to correct a umbilical hernia, this will be done at the cost of the new owner. You will notice they often will sniffle or snort. A clear discharge from the nose is normal, especially in puppies as they are teething. Tight nostrils will often widen as the puppy matures. A few other items not covered and not limited to are, patella problems, pinched nostrils, hypoglycemia, hernias, or any condition prevented by vaccination. SELLER will not cover any vet costs associated with the puppy after the transfer of ownership unless covered in the warranty agreement and unless the appropriate steps are taken to decide treatment as noted above.

7. PUPPY CERTIFICATION. SELLER agrees that to the best of our knowledge, puppy will be in good health and checked by Jessica Levy at Holistic Vet Care prior to delivery. It is our belief that your puppy will be free of any infectious or contagious disease. Puppy must remain unvaccinated for contract to remain in place. BUYER can choose to have the puppy checked by your choice of vet within 72 hours of transfer/pick-up, but this is not required-. Any visits are the sole responsibility of the BUYER. SELLER assumes no responsibility for medical expenses for allergies or any other circumstances with training etc. once the puppy has been transferred to BUYER.

8. GUARANTEE. Shih Tzu’s will sometimes slightly change in color as the dog matures, SELLER does not guarantee the adult size and color. The adult size and color can only be estimated based on information available.

PURPOSE OF AGREEMENT

Masterpiece Shih Tzu is a breeding program dedicated to preserving and improving the Shih Tzu breed in accordance with generally accepted breed standards. The Breeder agrees to place the dog described below in the Guardian’s home, and the Guardian agrees to provide proper care, maintenance, and availability for breeding purposes under the terms of this Agreement.

OWNERSHIP

The dog shall remain the sole legal property of Masterpiece Shih Tzu until all breeding obligations have been fulfilled and ownership is formally transferred in writing. The Guardian acknowledges they have no ownership rights until such written transfer occurs.

BREEDER RESPONSIBILITIES

The Breeder agrees to:

  • Provide feeding, care, and housing guidelines consistent with optimal breed health

  • Provide direction regarding veterinary care and breeding readiness

  • Cover costs of all breed-related genetic testing and reproductive veterinary care

  • Maintain responsibility for all breeding decisions, including selection of mates

  • Ensure breeding practices align with ethical and generally accepted Shih Tzu breeding standards

GUARDIAN RESPONSIBILITIES

The Guardian agrees to:

  • Provide daily care, supervision, exercise, and a safe home environment

  • Feed a high-quality diet (raw and/or natural foods as directed by Breeder)

  • Maintain routine grooming appropriate for the Shih Tzu breed

  • Provide general veterinary care, including routine checkups (only as approved by Breeder)

  • Keep the dog at a healthy weight and physical condition suitable for breeding

  • Notify Breeder immediately of illness, injury, or behavioral concerns

  • Ensure the dog is not exposed to situations that could result in unintended breeding

  • Make the dog available to the Breeder upon request for breeding, whelping, or related care

BREEDING STANDARDS AND PRACTICES

The Breeder and Guardian agree that all breeding will adhere to generally recognized ethical and breed-specific standards, including but not limited to:

  • Breeding only dogs that demonstrate sound temperament, good health, and structural correctness consistent with the Shih Tzu breed standard

  • Completion of appropriate health screenings (e.g., patella evaluation, eye exams, and other recommended genetic tests) prior to breeding

  • Avoidance of breeding dogs with known hereditary defects or disqualifying traits

  • Limiting the frequency of breeding cycles to protect the health and well-being of the dog

  • Ensuring proper prenatal, whelping, and postnatal care for all litters

  • Maintaining proper socialization and humane treatment of all dogs at all times

  • Following applicable kennel club guidelines (e.g., AKC or equivalent standards) where relevant

MEDICAL AND ALTERATION RESTRICTIONS

  • The Guardian shall not spay or neuter the dog without the expressed written consent of the Breeder.

  • The Guardian shall not authorize any major medical procedure without consulting the Breeder, except in emergency situations where immediate action is required to save the dog’s life.

  • Vaccination protocols and medical decisions must be discussed with and approved by the Breeder.

REMOVAL OF DOG

The Breeder retains the right to remove the dog at any time if:

  • The Guardian fails to comply with the terms of this Agreement

  • The dog’s health, safety, or welfare is at risk

  • The Guardian fails to properly care for or maintain the dog

No financial compensation will be owed to the Guardian upon removal due to breach of contract.

TRANSFER OF OWNERSHIP

Ownership of the dog will transfer to the Guardian only after:

  • All breeding obligations are fulfilled, and

  • The Breeder provides written confirmation of release of ownership

IMMEDIATE PAYMENT CLAUSE

The Guardian agrees to pay $15,000 to the Breeder if the dog is:

  • Altered (spayed/neutered) without written permission

  • Intentionally harmed or neglected

  • Withheld from the Breeder when required for breeding purposes

  • Bred without authorization

GENERAL TERMS

  • This Agreement represents the entire agreement between the parties

  • Any modifications must be made in writing and signed by both parties

  • This Agreement shall be governed by the laws of the state in which the Breeder operates
